1. Acceptance

By accessing or using veldtandvein.com (the "Site"), you agree to these Terms of Use. If you do not agree, do not use the Site.

2. Who we are

3. Site purpose — editorial only

At present the Site is editorial. We do not sell products directly through the Site. Wholesale and trade enquiries are subject to our separate Wholesale & Trade Enquiry Terms and are not binding offers.

We reserve the right to introduce direct-to-consumer sales in future, in which case additional terms (including a Sale of Goods Agreement, Returns Policy, and Shipping Policy) will apply, and these Terms of Use will be updated accordingly.

4. Intellectual property

All content on the Site — including the VELDT & VEIN word mark, logo, debossed packaging design, terracotta wax-seal motif, the names of our products, photography, illustrations, AI-assisted imagery, copy, journal articles, ingredient narratives, and the Site's overall look and feel — is owned by or licensed to the Company.

You may view and download Site content for personal, non-commercial use only. You may not reproduce, modify, distribute, transmit, publish, or create derivative works of Site content without our prior written consent, except for short fair quotations with attribution.

5. User-submitted content

When you submit information through any form on the Site (contact, newsletter, wholesale enquiry, press enquiry), you grant the Company a non-exclusive, worldwide, royalty-free, perpetual licence to use, store, and process that information for the purposes set out in our Privacy Policy. You confirm that the information you submit is accurate and that you have the right to share it.

6. Prohibited conduct

You agree not to:

• Use the Site for any unlawful purpose;
• Scrape, mirror, or systematically extract Site content;
• Use the Site, its content, or its imagery to train any AI model without our express written consent;
• Attempt to interfere with, compromise, or disrupt the Site or its security;
• Impersonate any person or misrepresent your affiliation with any person or entity;
• Submit false, defamatory, or infringing content through any form on the Site.

The Site may link to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites. Following a link is at your own risk.

8. Disclaimer of warranties

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED SINGAPORE DOLLARS (SGD 100), OR THE MINIMUM AMOUNT NOT EXCLUDABLE BY APPLICABLE LAW, WHICHEVER IS HIGHER.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

10. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Site, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

11. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections 4, 5, 8, 9, 10, 12, 13 and 14 survive termination.

12. Changes to these terms

We may update these Terms. Material changes will be noted at the top of this page with a new "Last updated" date. Your continued use of the Site after changes are posted means you accept them.

13. Severability, entire agreement, no waiver

If any provision of these Terms is held unenforceable, the remainder remains in effect. These Terms (together with our Privacy Policy and any additional terms referenced) constitute the entire agreement between you and the Company regarding the Site. Failure to enforce a right is not a waiver of that right.

14. Governing law and dispute resolution

These Terms are governed by the laws of Singapore.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the Arbitration Rules of the SIAC for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English.

Notwithstanding the above, you (if you are a consumer in a jurisdiction that gives you a non-waivable right to bring small claims locally) may bring an action in your local courts for amounts within the small-claims threshold of that jurisdiction.
